Tips After A Taxi, Uber, Or Lyft Accident In New York

Many tourists and residents use taxis, Uber, or Lyft to get around New York.

But these vehicles also add to road congestion and hazards, and crashes involving them can injure passengers, other drivers, bicyclists, and pedestrians.

What should you do if you’ve been hit by a taxi or Uber? What are the steps involved in filing a claim? How are New York no-fault insurance laws enforced? Is it necessary to hire an attorney? Find out below.

What You Can Do After an NYC Taxi, Uber, or Lyft Accident

Getting in touch with a large company like Uber or Lyft after a car accident can be challenging and frustrating. Their process is designed to protect their interests when handling accident claims. But here are the steps to follow after an NYC taxi, Uber, or Lyft accident:

  • Call 911 for emergency services
  • Get a full medical evaluation
  • Record the name of the taxi company or ride-sharing service
  • Find the taxi or Uber driver’s name, ID number, license information, and commercial license
  • Note the vehicle’s license plate and any other identifying information
  • Take pictures of the accident scene
  • Get a witness’s contact information
  • Describe every detail of the accident before, during, and after
  • Follow your doctor’s orders strictly
  • Consult a lawyer. An attorney can help you pursue fair compensation, whether through a settlement or a court award.

Claiming no-fault insurance

Every vehicle registered in New York, including taxis and Uber and Lyft cars, must carry No-Fault insurance. In New York City, Uber and Lyft cars are for-hire vehicles licensed by the Taxi and Limousine Commission. The state’s rideshare law, which sets insurance levels based on whether the driver was logged in to the app or carrying a passenger, does not apply to trips that start in the city (VTL 1691; VTL 1700). Regardless of fault, New York’s mandatory No-Fault coverage pays up to $50,000 per person in basic economic loss, such as medical bills and lost wages (Insurance Law § 5102(a)). You must give the insurance company written notice within 30 days of the accident (11 NYCRR 65-1.1).

The New York ride-sharing accident lawyer at The Eskesen Law Firm handles cases involving ride-sharing accidents. Rideshare companies and their insurers push back against almost any claim for personal injury or property damage.
