What is the statute of limitations for New York?
If you want to file a claim then one of the most important aspects of this claim will be ensuring that you file your claim on time. For most personal injury actions, the statute of limitations in New York is typically three years from when the incident occurred. Are there reporting requirements for car accidents in New York?
In New York, the law states (according to VTL 600) that while at the scene, you must exchange information with the other person and/or report the accident to the police before leaving. Moreover, in some cases there is an additional requirement to report the accident to DMV. Under Section 605 of the NY State Vehicle and Traffic Law, all drivers involved in an accident where: a person is injured or killed, or there is damage to the property of one individual (including yourself) in excess of more than $1,000, must file their own accident report within 10 days from the date of accident or DMV may suspend your driver’s license until your report is received.
